Terms and Conditions

1. TERMS AND CONDITIONS OF USE

I (if an individual) or (if a company, group or family) understand that the function of UrCommunity Timebanking System (UTS) is to facilitate the exchange of services, skills and products within the community. Agreements shall be made by and between UTS participants involved in this transaction and UrCommunity will not be held responsible and will not assume any liability for claims, damages, losses or any other consequences which may arise from this agreement.

You acknowledge and agree that UTS is not involved in the actual transaction between participants. UTS makes no representation or warranty as to the skill, qualifications, expertise or availability of any UTS participants, or the truth and accuracy of listings. Any employment relationship, partnership, joint venture agreement or other similar relationship between the participants and UTS is expressly negated. Any agency agreement is hereby expressly negated and the participants have no authority to bind the UTS.
When you enter into an agreement with another participant, you may be creating a legally binding agreement with that other participant. You are responsible for ensuring that you comply with your obligations to that other participant. If you do not, you may become liable to him or her. You should be aware or make yourself aware of any laws relevant to you or the services that you provide. If obligations are breached it is up to the participant and not UTS to enforce those obligations.

2. ACCOUNT HOLDERS

Only registered account-holders over the age of 18 years may use the system to advertise and trade and no third party may trade through a registered account holder’s account. Shared accounts must name all members responsible for the account.

New account-holders must start with at least one offering on the system. Registrations with no offerings cannot become account holders.

2.1 ONLY ONE ACCOUNT unless otherwise authorised by the Administrator, account-holders may only operate one account in the system.

2.2 ACCOUNT HOLDERS’ NAMES Account holders may use personal names or an alias for the names of their accounts.

3. EXCHANGES

One hour given to helping others, is equivalent to one hour earned and can be used to request an hour’s service from other members.

Account-holders may not charge interest for lending UTS Credits to other members.

3.1 ACTIVITY RECORDS Hours earned are entered into the system by the giver on the basis indicated on the website. This procedure may be changed from time to time by the Administrators.

3.2 LEVIES Administration shall be entitled to charge levies against trades done via the exchange.

The amount of the levy shall be as set or amended by the administration from time to time.
The administration shall be entitled to use the levies accrued to manage and further the aims of UrCommunity Ltd.

3.3 CREDIT/DEBIT LIMITS

3.3.1 Account-holders shall not be entitled to begin using the UTS without having a positive balance. The initial balance for all account holders is 9 hours, upon completion of the registration pages.

3.4 ACCOUNT INFORMATION Trading balances of all account holders are available to all account-holders but details of individual activities are not.

4. ADVERTISING

4.1 Advertisements for offerings must be honestly described. Advertisements considered offensive to others, inaccurate, illegal or contrary to the ethics of the system may be deleted by the Administrators at their absolute discretion.

4.2 An offer advertised on the system amounts to an invitation to do business only and shall not constitute an irrevocable offer to all.

4.3 You are solely responsible for all the information that you provide to UTS. UTS acts as a passive holder of Your Information which we publish and distribute.

5. DISPUTE RESOLUTION

5.1 If any dispute should arise between account-holders the matter shall be referred to the Administrators for mediation.

5.2 The Administrators decision will be final and binding on all parties.

6. INACTIVE ACCOUNTS

6.1 If there has been no activity regarding a particular account for a period of 12 months then the account will be considered to be inactive. Administrators shall be entitled to close the account, after having given reasonable notice to the account-holder, in which event:

6.2 Any credit balance will be forfeited.

6.3 Account-holders with an inactive account that shows a debit will not be entitled to re-activate their account with UTS until that account has been restored to 0 hours.

7. LEAVING AND CLOSURE OF ACCOUNT

If an account-holder wishes to leave UTS voluntarily, they shall apply to the Administrators for closure of their account by email. In such event the account holder will be required to restore the account to 0 hours.

8. SUSPENSION AND TERMINATION

8.1 The Administrator can suspend an account of any account-holder who breaches any material trading rule or who acts in a way considered to be unethical or contrary to the norms of UTS.

8.2 The Administrator shall notify any account-holder if their account has been suspended, and the account-holder shall have fourteen days to dispute the suspension. If no dispute is notified to the Administrators, then the Administrators will terminate the account.

9. CHANGES

Administrators shall be entitled to change the terms of use from time to time. In such event, the applicable terms will be those prevailing at the time of the action or transaction involved.

10. PRIVACY

10.1 UTS will collect and store the information you voluntarily provide to enable processing of enrolments for the program/registration in the program.

10.2 The information will be provided to relevant authorised staff.

10.3 You consent to these disclosures.

10.4 Any information provided by you will be stored on a secure database that will only be accessed by authorised personnel and is subject to privacy restrictions

10.5 The information will only be used for the purpose for which it was collected. Any information provided by you to UTS can be accessed by you during standard office hours and updated by contacting the Administrators

11. DISCLAIMERS AND INDEMNITIES

11.1 Neither UTS nor the Administrators are parties to any transaction between a receiver and a giver, and accept no responsibility for the performance of UTS parties nor as to their identity or trustworthiness nor as to the nature of any activities they undertake.

11.2 Neither UTS nor the Administrators accept responsibility for any loss or damage occasioned to any account-holder as a result of information received via the system becoming available to other account-holders or outsiders.

11.3 Account-holders agree to indemnify and hold harmless UTS and the Administrators and any of their employees or agents from activities agreed with other members, or from incidents of loss, damage or injury arising out of the use of the system. You will indemnify UTS for any loss, damage, injury or death caused as a result of the services provided by the participant, or any breach of the terms of this agreement, even if that loss or damage is suffered after the termination of this agreement. To the extent permitted by law, you agree that UTS has no legal responsibility for the actions of participants and/or account holders.

11.4 You are responsible for any tax implications or liabilities in relation to transactions that you enter into as a result of participating in UTS. UTS does not warrant or represent that it has examined the tax implications of any transactions that a participant/account holder may enter into. It is your responsibility to ensure that you are aware of any tax obligations and that you meet those obligations.

12. $3 MEAL DEAL MEMBERSHIP

12.1 The meals that are part of the $3 Meal Deal are not for sale. They are provided free of charge to holders of a current membership. The membership fee is an administrative fee, which assists the program to cover the costs involved with preparing, distributing and more generally, the cost of running the $3 Meal Deal program.

12.2 There are four levels of membership that a customer can choose from and they are:

a) Casual Membership – Available at the cafés  (Offered to the general public to try our meals and meals are offered either with or without a membership number for that purpose)
b) Weekly Membership – Only available online
c) Monthly Membership – Available online or at our cafés
d) 3 Monthly Membership – Available online or at our cafés

12.3 Online subscriptions are important because they help us plan how many meals are required each day.

12.4 Please note – Subscription memberships mean that you will be charged on a regular basis, based on the level of membership you have chosen. Example: If you have subscribed to a weekly membership, you will be charged weekly for the cost of the weekly membership.

12.5 To suspend or cancel a subscription membership, you must log onto your PayPal account and suspend or cancel it.

12.6 As every dollar received is spent on ensuring that we are able to help as many Australians as possible, we do not offer refunds. If a refund is requested, we will review and action each request on a case by case basis. Please also note that if you elect to request a refund and a refund is granted, we will assume that you will no longer wish to participate in the programs run by UrCommunity and your membership will be cancelled. This also means that you will not be eligible to participate in any of our meals programs or receive any other assistance from UrCommunity in the future.

12.7 Refund Policy for the $3 Meal Deal

Memberships are time based, which means that if you do not use the credits within the allocated time frame, they become null and void. Exceptions include:

a) If you’ve purchased a monthly membership, we’ll allow you the flexibility of taking a few more one week and a few less the other week as required.
b) If you come to the end of your membership and still have outstanding credits, you will have the option of rolling them over, if you renew your membership.
If you decide to cancel your membership, you will only be eligible to receive a refund for One membership period for credits not used.

Example 1: You’ve signed up to a weekly membership and you haven’t used your credits for four weeks but decide you do not want to continue. You will be eligible to receive a refund for One weeks’ worth of membership.

Example 2: You’ve signed up to a 3-month membership and 10 weeks in you decide you do not want to continue. In this instance, you will be eligible to receive a refund for the remaining 3 weeks, assuming you haven’t already used up the credits in additional meals or other products/services.

13. UNDERTAKING AND ACCEPTANCE

I/we accept the above terms of use and conditions and undertake further to:

13.1 Negotiate agreed UTS activities with other members.

13.2 Keep personal or group contact details, offers and requirements updated. It is my/our responsibility to determine the amount of personal information that is shown to other members.

13.3 Advise the Administrators if I/we should wish to de-register.

13.4 I/we nominate my/our email address as used on UTS as the address at which I/we choose to receive communications and notices.

By clicking here, I/we acknowledge that I/we have read the above terms of use and conditions and are bound by them to UTS and the Administrators, as well as to other users. I/we acknowledge further that these terms and conditions may be changed by UTS Administrators from time to time and I/we understand and accept that it is my or our responsibility to keep abreast of any changes.
